NOTICE OF SUBSTITUTE TRUSTEE’S SALE OF LAND

         WHEREAS, STANLEY BARTLETT by Deed of Trust dated December 19, 2011 recorded in Deed of Trust Book 345 at Page 603 of the Deed of Trust records of the Office of the Chancery Clerk of Stone County, Mississippi, conveyed certain property therein described in trust to David M. Allen, to secure payment of a certain indebtedness to The Peoples Bank, Biloxi, Mississippi; and WHEREAS, STANLEY H. BARTLETT by Deed of Trust dated April 3, 2012 recorded in Deed of Trust Book 348 at Page 610 of the Deed of Trust records of the Office of the Chancery Clerk of Stone County, Mississippi, conveyed certain property therein described in trust to David M. Allen, to secure payment of a certain indebtedness to The Peoples Bank, Biloxi, Mississippi; and WHEREAS, said Deeds of Trust expressly provide for the appointment by the party beneficially interested therein of a successor to the Trustee therein named in the manner therein provided, which said successor and substituted Trustee shall have the same title, authority, rights and powers as the Trustee therein originally named; and WHEREAS, The Peoples Bank, Biloxi, Mississippi as the holder of the Note secured by said Deeds of Trust and the indebtedness secured thereby and the security therefor, did substitute and appoint David A. Wheeler as Trustee in the place and stead of David M. Allen by Substitution of Trustee dated June 20, 2019 and recorded in Book 432 at Pages 3-6; and WHEREAS, default having been made in the terms and conditions of the said Deeds of Trust and the entire debt secured having been disclosed and payable in accordance of the terms of said Deeds of Trust, and the legal holder of said indebtedness, The Peoples Bank, Biloxi, Mississippi, having requested the undersigned Substitute Trustee to execute the trust and sell said land and property in accordance with the terms of said Deeds of Trust for the purpose of raising the sums due thereunder together with attorney’s fees and expenses of sale. NOW, THEREFORE, the undersigned Substitute Trustee, pursuant to such authority and the request so made does hereby give notice that he will sell during the legal hours (between the hours of 11:00 a.m. and 4:00 p.m.) on the 24th day of July, 2019, at the front door of the Stone County in Wiggins, Mississippi, for cash to the highest and best bidder, the following described land and property being located and situated in Stone County, Mississippi, and being more particularly described as follows, to-wit: Commence at the SW corner of the NE 1/4 of the SW 1/4 of Section 8, Township 2 South, Range 11 West, Stone County, Mississippi; thence run East 53 feet to the East right-of-way of Highway 29; thence run North 185 feet the point of beginning; thence run East 255 feet; thence run North 155 feet; thence run West 255 feet, more or less, to the East right-of-way of said Highway 29; thence run South along and with said right-of-way 155 feet, more or less, back to the point and place of beginning.
