SUBSTITUTED TRUSTEE’S NOTICE OF SALE
STATE OF MISSISSIPPI COUNTY OF Stone
WHEREAS, on the 31st day of May, 2016, Robin Ann Konnik, a single person, executed and delivered a certain Deed of Trust unto J Morton Matrick, Trustee for Mortgage Electronic Registration Systems, Inc. as nominee for Mortgage Lenders of America, LLC, Beneficiary, to secure an indebtedness therein described, which Deed of Trust is recorded in the office of the Chancery Clerk of Stone County, Mississippi in Book 398 at Page 183; and
WHEREAS, on the 29th day of August, 2018, the Holder of said Deed of Trust filed a Loan Modification Agreement of Deed of Trust by instrument recorded in the office of the aforesaid Chancery Clerk of Court in Book 423 at Page 501; and
WHEREAS, on the 30th day of June, 2017, Mortgage Electronic Registration Systems, Inc. as nominee for Mortgage Lenders of America, Limited Liability Company, assigned said Deed of Trust unto Wells Fargo Bank, N.A., by instrument recorded in the office of the aforesaid Chancery Clerk in Book 411 at Page 327; and
WHEREAS, on the 25th day of March, 2019 the Holder of said Deed of Trust substituted and appointed Dean Morris, LLC as Substitute Trustee by instrument recorded in the office of the aforesaid Chancery Clerk in Trust Deeds Book 429 at Page 502; and
WHEREAS, on the 15th day of April, 2019, a Scrivener's Affidavit was recorded via instrument appearing in the aforesaid land records to correct an error in the legal description in the subject deed of trust; this Affidavit appears inTrust Deeds Book 429 at Page 777; and
WHEREAS, default having been made in the payments of the indebtedness secured by the said Deed of Trust, and the holder of said Deed of Trust, having requested the undersigned so to do, on the 19th day of June, 2019, I will during the lawful hours of between 11:00 a.m. and 4:00 p.m., at public outcry, offer for sale and will sell, at the front west door of the Stone County Courthouse at Wiggins, Mississippi, for cash to the highest bidder, the following described land and property situated in Stone County, Mississippi, to-wit:
Commence at the NE corner of the SE 1/4 of the NW 1/4 of Section 36, Township 2 South, Range 12 West, Stone County, Mississippi; thence South 89 degrees 35 minutes 00 seconds West along the forty line, a distance of 294.10 feet to a point; thence South 37 degrees 08 minutes 00 Seconds East, a distance of 989.70 feet to a point located on the Northern right-of-way of Woodland Drive; thence North 76 degrees 06 minutes 43 seconds East, a distance of 93.48 feet to the P.C. of a Curve: thence South 08 degrees 54 minutes 47 seconds East a distance of 60.00 feet to the P.C. of a Curve and the true Point of Beginning; thence North 81 degrees 05 minutes 13 seconds East along the South right-of-way of said Woodland Drive, a distance of 100.49 feet to a point; thence South 27 degrees 58 minutes 45 seconds East, a distance of 417.02 feet to a point; thence South 70 degrees 57 minutes 26 seconds West, a distance of 202.35 feet to a point; thence North 27 degrees 58 minutes 44 seconds West, a distance of 441.56 feet to a point located on the South right-of-way of the said Woodland Drive; thence around a curve to the right through arc distance of 107.69 feet, a chord bearing of North 74 degrees 27 minutes 57 seconds East, a distance of 107.45 feet to the Point of Beginning; the property contains 2.00 acres more or less, and is located in the SW 1/4 of the NE 1/4 of said Section 36.
I will only convey such title as is vested in me as Substitute Trustee.
