STATE OF MISSISSIPPI COUNTY OF STONE SUBSTITUTED TRUSTEE’S NOTICE OF SALE WHEREAS, on the 20th day of November, 2008, CYNTHIA B. FAIRLEY, executed a Deed of Trust to BYRON J. STOCKSTILL, Trustee, for the benefit of SOUTHERN NATIONAL BANK, A BRANCH OF FIRST NATIONAL BANK OF PICAYUNE, said Deed of Trust being of record in Deed of Trust Book 308 at Page 227, with said Deed of Trust being modified by KEN FAIRLEY and CYNTHIA B. FAIRLEY on the 31st day of May, 2013, of record in Deed of Trust Book 363 at Page 301, with further modification by KEN FAIRLEY and CYNTHIA B. FAIRLEY dated the 5th day of August, 2016, being of record in Deed of Trust Book 400 at Page 207; and WHEREAS, on the 31st day of May, 2013, KEN FAIRLEY and CYNTHIA B. FAIRLEY executed a Deed of Trust to BYRON J. STOCKSTILL, Trustee, for the benefit of SOUTHERN NATIONAL BANK, A BRANCH OF FIRST NATIONAL BANK OF PICAYUNE, said Deed of Trust being of record in Deed of Trust Book 363 at Page 293 of the Records of Mortgages and Deeds of Trust on Lands of said County; and WHEREAS, on the 5th day of August, 2016, KEN FAIRLEY and CYNTHIA B. FAIRLEY executed a Deed of Trust to BYRON J. STOCKSTILL, Trustee, for the benefit of SOUTHERN NATIONAL BANK, A BRANCH OF FIRST NATIONAL BANK OF PICAYUNE, said Deed of Trust being of record in Deed of Trust Book 400 at Page 212 of the Records of Mortgages and Deeds of Trust on Lands of said County; and WHEREAS, default was made and now exists in the payment of the indebtedness secured by the said Deed of Trust; and WHEREAS, SOUTHERN NATIONAL BANK, as owner and holder of said Deed of Trust and the indebtedness secured thereby, has exercised its option to appoint the undersigned THOMAS M. MATTHEWS, III as Substituted Trustee in the place and instead of BYRON J. STOCKSTILL, which instrument of Substitution of Trustee was executed on the 6th day of November, 2019, and is now of record in the aforesaid Chancery Clerk's Office, having been recorded in Deed of Trust Book 435 at Page 726 of the Records of Mortgages and Deeds of Trust on Lands of said County; and WHEREAS, SOUTHERN NATIONAL BANK, as owner and holder of said Deed of Trust, and the indebtedness secured thereby, has exercised the option contained in said Deed of Trust and declared the entire indebtedness secured thereby immediately due and payable, and has called upon the undersigned Substituted Trustee to execute the trust therein contained, and requested that the undersigned Substituted Trustee sell said property under the provisions of the Deed of Trust for the purpose of satisfying the debt thereby secured and unpaid, together with attorney's fees and the expenses of the execution of this trust and of the selling of said property. NOW, THEREFORE, I, the undersigned Substituted Trustee, THOMAS M. MATTHEWS, III, do hereby give notice that on Friday, the 13th day of December, 2019, during legal hours, I will proceed to sell at public auction, at public outcry, to the highest and best bidder for cash at the main front door of the Stone County Courthouse in Wiggins, Mississippi, the following described lands with all improvements thereon situated in Stone County, Mississippi, and described as follows, to wit: Lot 11, of Oak Ridge Estates Subdivision, Stone County, Mississippi, as per map or plat thereof on file in the office of the Chancery Clerk of Stone County, Mississippi, in Plat Book Slide Page 119; together with all improvements thereon and appurtenances thereunto belonging.
